The Importance of a Tenancy Agreement and Its Impact on Mental Health

When it comes to renting a home, the importance of having a tenancy agreement cannot be overstated. Not only does this essential document serve as a legal safeguard for both tenants, it also holds the power to impact your mental health in significant ways. 

When moving people on from CENS, we always try to secure them tenancies with reputable landlords. 

Unfortunately, some CENS residents have come from private lets where landlords and property management companies have not upheld their responsibilities of the agreement.

“We didn’t have heating for three weeks during December 2024. I asked a number of times, but, was ignored. I refused to pay the rent and was evicted. That’s when I came to CENS.” Anon, CENS resident.

Understanding a Tenancy Agreement

A tenancy agreement is a formal contract between a landlord and a tenant. This legal document outlines the rights and responsibilities of both parties and details important aspects such as rental payments, duration of the lease, maintenance responsibilities, and rules regarding the property. Often, tenants don’t realise that withholding rent, even if services are not being provided, can result in lawful evictions. That’s why CENS ensures our residents fully understand their rights and responsibilities under a tenancy agreement before they move on.

“The houseshare I was in was awful. Drug dealers would knock on the door at all hours. I refused to pay the rent until the other tenant was evicted. The landlord said I wouldn’t have to re-pay what I owed if I moved out. It shouldn’t have been me who left but I felt like I didn’t have much choice” Anon, CENS resident.

The Security of a Written Agreement

Luckily, these rogue landlords are a rarity and having a secure tenancy is the best outcome for a lot of CENS’ residents. Knowing that there is a set length of time you legally have the right to rent for can reduce anxiety and promote a sense of stability. Without a formal agreement, both parties may have differing interpretations of what was agreed upon, leading to confusion, disputes, and even legal complications.

“After sofa-surfing and relying on other people to help me, I was relieved to find a tenancy for a year. I’ve had licenses before, but under those agreements, you can be asked to leave with only 7 days notice. Avoiding Stressful Situations

Having a tenancy agreement helps prevent uncomfortable situations. For instance, if a landlord were to raise the rent unexpectedly or decide to terminate the lease without notice, the tenant could find themselves in a very stressful position. With a properly structured agreement, tenants can feel empowered, knowing they have documented rights and can reference specific clauses to protect themselves.
